Update: so far so good, our warranty percentage has increased by 10%, and we have not had any unforeseen "ramifications" so far from GM or Hyundai.

There are many myths about taking advantage of the new state laws that entitle dealers to apply for retail reimbursement for warranty parts and labor. The primary myth is about retaliation. The reality is there is no retaliation. The statutes prohibit it in most states. We have done over 1000 of these for dealers and not a single one has reported any retaliatory conduct. There is no excuse for any dealer not to seek retail. 40 states now have retail friendly statutes.

All good with GM and Hyundai no extra fees. Went from 31.5% GP to 35.5%

we used armatus last year. went from 40 to 62% reimbursement. I think we paid them $4000 to do the work. had a small sales audit in dec.. found
$3000 on nit picking. retaliation ?, don't know, 1st one we've had in 20 years.
glad we did it.

Here's a counter-balance to "retaliation." I was told that in a termination case, the factory submitted as proof of the dealer's incompetence the fact that he was too dumb to even ask for an increase of his warranty reimbursement to retail rates when the law allowed it. You might ask Len Bellavia about the case. He's knowledgeable about that kind of stuff. If you are nervous about asking for the increase, you might mention the case to your factory rep and explain to him that you really don't want to be labeled an incompetent dealer.

I was referring to the Chrysler and GM reinstatement arbitration’s in 2009 where rejected Dealers has to make a showing that they met certain criteria to qualify for reinstatement, essentially proving that they were good and productive Dealers. Chrysler and GM would argue that a Dealers’ failure to invoke their rights to receive warranty reimbursement at retail means they left money on the table that couldn’t be used for marketing and sales and therefore were not effectively representing the brand. Absurd. However, privately, there is no excuse for a dealer not taking advantage of these statutes which now, in 2018, exist in 40 states. Anyone concerned about retaliation or factory blowback should call Chris Forgione of my office as he heads up our Warranty Reimbursement Department and he will be happy to walk you through this. He has done thousands of these in all 40 states and does not charge a contingency fee like others do. (516-873-3000) He can show you what you stand to gain and at what cost. He can let you know how your manufacturer responds as well as they are all different. Don’t forget about a labor increase as well. Manufacturers try to discourage dealers from submitting but most dealers in “retail” states are proceeding. Best, Len Bellavia

The old dealer had warranty at retail, but the new dealer agreement missed it. I had to send a registered letter to the manufacturer showing them Montana law is retail. I got it with zero fuss.

Can anybody tell me where to find the procedure to get the parts increase, I can only seem to find very basic info on it. Can't seem to find the full procedure.
