I think moving on all fronts to protect investment is a wise action. If Global wins, a number of senarios become valid that do not include the dealer franchise investors. However, right now there is no senario that includes a dealer franchise investor, so I hope for a Global Victory. In fact, Global winning puts much needed CASH into Global, that then becomes available to the dealers in the class action suit (assuming a dealer victory). Looking at the leverage, if Global wins, Mahindra is more likely to BUY their way out of the problems, one way (cash out) or another (including buying Global and issuing a franchise they want to be successful with a full product line). Still dreaming I guess! Merry Christmas!

I just found this blog: http://mahindraplanet.blogspot.com/ . Basicly, it looks like Alabama is going to be a BIG WINNER on the U.S. build of the Mahindra Pickup in a partnership with Navistar. Lots of details in the article, seems to be some speculation, but a "lease" for a huge facility was "signed" by Navistar. Global Vehicles, In or Out, seems to be unimportant to this manufacturing deal. Still, unclear is "WHO of WHERE THE GLOBAL DEALERS ARE?"

Thanks for the update.

I read the article and it's clear this is a NEW case that's been filed against Mahindra and Mahindra.

To the extent U.S. Courts have already dismissed cased against Global Vehicles and Mahindra I'm not sure how far this case will proceed.

I do feel that the dealers who invested to obtain a Mahindra Franchise got shafted but it's not clear to me if the "villain" is Global Vehicles or Mahindra.

This is a new lawsuit. The last case was partially dismissed for lack of jurisdiction in St Louis. It was a class action case. This does not seem to be a class action, as there are particular named dealers with specific damages. As to who is the villain, Global could not have secured the dealers funds, if they had not acted with the outright conivance of Mahindra. There is only one party in this mess that has the financial wherewithall to pay up. Go where the deep pockets are!

I remember listening to the pitch about this time of year in 2009. When they said the franchise fee was not going to be put in escrow and was non-refundable I politely said no thank you and hung up.

Thanks for the information. Hopefully the dealers who were impacted will fare better with this lawsuit than they did with the former actions.

Concerning your comments regarding Mahindra, I'd be inclined to agree. Global would have never been able to convince dealers to make an investment unless it appeared that Mahindra was on-board and willing to support the new venture.
