Default Arbitration Results - General Motors 39, Dealers 23

That's great - it's always nice to hear about another dealer victory.

I've been wanting to start a thread tracking GM's arbitration results. I'll work on that this morning and then move your post to that thread.

Thanks for the info - I'll update the first post.

That's one of the few GM victories to be reported in the press and I'm sure the fact the dealer is running for Congress is what makes it newsworthy.

Did this dealership win their arbitration case or did GM settle and reinstate them prior to arbitration? I'm confused because when I just googled this dealership-- I found the following article:

Bob Daniels Buick gets GM reprieve
Dated: May 28, 2010

Link to article: http://columbus.bizjournals.com/colu...4/daily37.html

This article states the following:

"The reprieve process General Motors Corp. extended to more than 661 dealerships has saved at least one Columbus seller.

Bob Daniels Buick GMC Truck on Morse Road said this week that GM has reinstated the dealership after originally planning to cut it off from its sales network."

Please let us know regarding this case and any others that you find out about. Thanks!

It looks like it was a reinstatement by GM in an effort to settle an arbitration case.

In fact, I'll add a new section to the first post so we can list dealers that GM agreed to reinstate to settle their arbitration case. To GM's credit, it appears they've done this with a number of cases and in my opinion it's a "win-win" for both sides.

Default Alderman Motors will be reinstated by GM

News reports indicate GM has settled another arbitration case by offering to reinstate Alderman Motors. For the full report - click here

I thought it was interesting that the dealer had support from their Congressman, their Senator and the State Attorney General. That level of support seems to be lacking in most other arbitration cases.

I think your right XMAN...When a Columbus bank rep was in he made it sounds like it was in arbitration.....

But yet their is alot of Dealerships getting back they stores with out going to arbitration. Which is weird, thought that most had to go with arbitration after a certain date.

As I understand it the law is written that all arbitration cases have to be heard by a certain date but the cases can be settled at any point. To their credit GM is settling a lot of their cases by offering reinstatement and they seem to be generating a lot of community goodwill.

Default Wagner Motor Car Company reinstated by General Motors

News reports indicate GM has settled another arbitration case by offering to reinstate Wagner Motor Car Company. For the full report - click here

I received this information from someone who reads the forum on a regular basis but is not a member. He indicated GM's decision to reinstate this dealer generated a lot of positive public relations within the community.

In this case GM did the right thing and the community feels a sense of accomplishment. Sounds like a "win-win" deal to me.

Well I just heard that the dealership that I was the Manager at just got their store back. It appears that that they negotiated with GM vs. it going into full arbitration.

http://www.timescall.com/news_story.asp?ID=22288

They are still fighting with Chrysler so it will be interesting to see how that peice ends up.

That's great news - I'll add the store to the list of the ones GM has settled with.

It was interesting to read that GM has reinstated 16 of the 25 stores they closed in Colorado and the terms of their LOI are fair and reasonable.

Default Had our hearing this week

We had our hearing this week. I think it was the most intense week I have ever been through. GM threw everything they could at us, but they did not have much to work with since our DPS is close to 100. We have to submit the summary brief then the waiting begins. I think I'll work on a press release now so it's ready to go if we get the good word. I would like to thank Alan Spitzer, Jack Fitzgerald, and Tammy Darvish, without their efforts none of this would have been possible.

Thanks for the update. I'll be wishing you good luck for a favorable ruling.

Concerning DPS, I'm assuming that's the same measure as Chrysler's MSR (Minimum Sales Requirement)?

I totally agree. Without CRDR nothing would have happened and the plight of the rejected dealers would have faded with time. As I've stated countless times, in my opinion the NADA did NOTHING for the rejected dealers - they're a failed organization.

In the end my bet is the actions of CRDR will result in the reinstatement of 800+ GM dealerships with financial settlements for hundreds more.
