This case will go forward. What is right is right and will be brought out in court. I have faith in Bellavia and Gentile and their associates in this case. It will happen.

I am absolutely delighted to report to you some important news on our lawsuit against the United States Treasury.
Today, we received the Order and Opinion of Judge Robert H. Hodges, Jr. which DENIED in all respects the motion of the Government to dismiss our case.
This is an extremely important development. Judge Hodges is allowing our case to proceed because it presents a “unique” “Takings” claim on both the facts and the law.

Judge Hodges gave the same decision in the Colonial Chevrolet case led by Richard Faulkner. That case was heard the next day. It includes General Motors dealers in addition to Chrysler dealers.

Man, to be a fly on the wall during some of these upcoming depositions and document requests would be absolutely priceless. The amount of cockamamie b.s. will be epic~ Executive privilege.

The government's court filing system is at www.pacer.gov. You need to register for access using a credit card. Once registered go to the Court of Federal Claims section. The Alley's of Kingsport case is No. 11-100C. The Colonial Chevrolet case is
No. 10-647C. It costs 8 cents for each page downloaded. You will have access do dockets, documents filed, motions and decisions related to the case.

That's a good question....

The last I heard the case was moving slowly through the justice system despite the Government's efforts to get the case dismissed.

I recall being told the judge is expected to rule on the latest motion to dismiss by the government in Sept or Oct. Just another frustration in this whole mess.
